EU 2023/1442 Comes into Effect

EU 2023/1442 amending Annex I to Regulation (EU) No.10/2011 on plastic materials and articles intended to come into contact with food was published on July 11, 2023.

It reduces the specific migration limit (SML) for the five following substances from a group commonly known as ‘phthalates’:

  1. Benzyl butyl phthalate (BBP, CAS 85-68-7);
  2. Dibutyl phthalate (DBP, CAS 84-74-2);
  3. Bis(2-ethylhexyl) phthalate (DEHP, 117-81-7);
  4. 1,2-Benzenedicarboxylic acid, di-C9-11-branched alkyl esters, C10-rich (DIDP, CAS 68515-49-1); and
  5. Diisononyl phthalate (DINP, CAS 28553-12-1).
  • SML for DEHP is decreased from 1.5mg/kg to 0.6mg/kg;
  • SML for DBP is decreased from 0.3mg/kg to 0.12mg/kg;
  • SML for BBP is decreased from 30mg/kg to 6mg/kg; and
  • SML for the sum of DINP and DIDP is decreased from 9mg/kg to 1.8mg/kg.

This Regulation also revokes the authorisation for substances ‘wood flour and fibers, untreated (FCM No.96) and salicylic acid (FCM No.121)’. Furthermore, these five substances were added to the authorisation list.

EU 2023/1442 entered into force on August 1, 2023. Plastic materials and articles complying with Regulation (EU) No 10/2011 as applicable before the entry into force of this Regulation, which are first placed on the market before February 1, 2025, can remain on the market until the exhaustion of stocks.
